AI and the CLNC part 2:
Artificial Intelligence (AI) can help Certified Legal Nurse Consultants (CLNCs) work faster and more efficiently, especially when reviewing thousands of pages of medical records. But when those records contain Protected Health Information (PHI), HIPAA compliance becomes a critical issue.
🔹 Where HIPAA Concerns Arise
- Cloud-based AI tools (like ChatGPT or similar platforms) may process data on external servers. Uploading unredacted PHI into these systems could be considered a HIPAA violation.
- Data storage & security: If the AI vendor doesn’t sign a Business Associate Agreement (BAA), they cannot legally process PHI on behalf of covered entities or their business associates.
- De-identification: Stripping records of names, addresses, MRNs, and other identifiers before AI use is essential to remain compliant.
🔹 How CLNCs Can Use AI Responsibly
- Work with de-identified records: Attorneys can provide records with PHI removed. AI can then summarize or extract data without HIPAA exposure.
- Choose HIPAA-compliant platforms: Some AI tools are beginning to offer BAA coverage and secure data handling — these may become the gold standard for legal and medical review.
- Use AI as an assistant, not a decision-maker: AI can help with organizing and summarizing, but the CLNC applies nursing judgment to analyze the case, keeping interpretation in human hands.
⚖️ The Attorney’s Advantage
When attorneys work with a CLNC who leverages AI safely:
- Case reviews move faster without risking PHI breaches.
- Records are summarized and organized efficiently.
- The CLNC’s expertise ensures that AI output is filtered through professional nursing judgment — identifying standard of care issues, causation, and credibility.
âś… Bottom Line
AI is a powerful tool, but HIPAA doesn’t go away when technology enters the picture. Attorneys need CLNCs who understand both nursing standards of care and the legal safeguards around patient privacy. That combination keeps cases strong, efficient, and compliant.
